Thành Lập Chính Quyền Trung Ương Việt Nam Cộng Hoà
Tổng Thống CPVNCHLV ra sắc lệnh:
Điều 1. Chính quyền trung ương Việt Nam Cộng Hoà sẽ gồm có ba ngành: lập pháp, hành pháp và tư pháp. Ba ngành này độc lập với nhau và cân bằng quyền lực của nhau để ngăn ngừa độc tài. Sự vận hành, quyền hạn, và trách nhiệm của ba ngành hành pháp, lập pháp và tư pháp của Chính Phủ Việt Nam Cộng Hoà tương tự như trong hành pháp, lập pháp và tư pháp của Chính Phủ Hoa Kỳ.
Điều 2. Hành pháp sẽ gồm có tổng thống, phó tổng thống, thủ tướng và các bộ trưởng. Nhiệm kỳ tổng thống là 4 năm; tối đa, 2 nhiệm kỳ liên tiếp. Tổng Thống bổ nhiệm Phó Tổng Thống và Thủ Tướng.
Điều 3. Nội Các Chính Phủ Việt Nam Cộng Hoà sẽ gồm có 16 bộ. Các Bộ Trưởng được Thủ Tướng đề nghị, Tổng Thống bổ nhiệm và Thượng Viện phê chuẩn.

– Bộ Năng Lượng

– Bộ Thương Mại
– Bộ Cựu Chiến Binh
Điều 4. Mỗi bộ ở trung ương sẽ có 82 nhân sự, gồm: 1 bộ trưởng, 3 Sở/Vụ Trưởng, 9 Nha Trưởng, 27 Trưởng Phòng. Mỗi Sở/Vụ, Nha, Phòng có 3 người. Tại địa phương, cấp tỉnh có Ty gồm 4 người; cấp xã có Ban gồm 2 người. Bộ trưởng có toàn quyền quản trị nhân sự trong bộ của mình.
Điều 5. Lập pháp sẽ gồm có Hạ Nghị Viện và Thượng Nghị Viện:
– Hạ Nghị Viện sẽ gồm có 100 dân biểu. Mỗi dân biểu đại diện cho khoảng một triệu dân. Số dân biểu từ mỗi tỉnh/thành tuỳ thuộc vào dân số ở tỉnh/thành đó. Nhiệm kỳ dân biểu là hai năm. Tối đa 5 nhiệm kỳ.
– Thương Nghị Viện sẽ gồm có 34 nghị sĩ. Mỗi nghị sĩ đại diện cho một tỉnh/thành. Nhiệm kỳ thượng nghị sĩ là 6 năm. Tối đa 5 nhiệm kỳ.
Điều 6. Tư pháp sẽ gồm Tối Cao Pháp Viện và 3 Toà Khiếu Nại (Toà Phúc Thẩm) của 3 Miền: Bắc, Trung, Nam, thuộc Trung Ương. Đại thẩm phán Tối Cao Pháp Viện và thẩm phán Toà Khiếu Nại do Tổng Thống đề cử và Thượng Viện phê chuẩn. Đây là những chức vụ trọn đời.
(Tại địa phương, sẽ có 34 Toà Thượng Thẩm của 34 đơn vị hành chính cấp tỉnh và Toà Hoà Giải cấp xã cho mỗi đơn vị hành chính cấp xã. Thẩm phán Toà Thượng Thẩm và Toà Hoà Giải do dân địa phương bầu chọn. Nhiệm kỳ 4 năm.)
Điều 7. CPVNCHLV chiếu sắc lệnh thi hành.

Republic of Vietnam Government in Exile

RE: Establishment of the Central Government of the Republic of Vietnam
The President of the Republic of Vietnam Government in Exile issues the executive order that:
Article 1.
The central government of the Republic of Vietnam shall consist of three branches: legislative branch, executive branch, and Judiciary branch. These three branches of government are independent from one another and balance one another’s powers to prevent tyranny. The operations, the powers, and the responsibilities of these three branches of government are somewhat the same as those of the US Government.
Article 2.
Executive branch shall include the president, the vice-president, and the secretaries. The term for the office of presidency is 4 years. One can hold two consecutive terms at most.
Article 3.
The Cabinet of the Republic of Vietnam Government shall include 16 departments. Secretaries are suggested by the Prime Minister, appointed by the President and approved by the Senate.

Article 4.
At central level, each department shall consist of 82 people on the average: 1 Secretary, 3 Undersecretaries, 9 Department Division leaders, 27 Department Office leaders; each group shall consist of 3 people.
At province level, there shall be 4 persons, at ward/village level, 2 persons. Secretaries have powers to manage human resources within their departments.
Article 5.
The Legislative branch shall include the House of Representatives and the Senate:
– The House of Representatives shall include 100 Representatives. Each representative represents about one million people. The number of representatives from each province or city depends on the population of that province/city. The term of the representative office is two years. One could serve 5 terms maximum.
– The Senate shall include 34 Senators. Each senator represents one province/city. The term of the senator’s office is six years. One could serve 5 terms maximum.
Article 6.
The Judiciary branch shall include the 9 Justices of the Supreme Court and the Judges of the Courts of Appeal in the Northern region, Central Region and Southern region for the central government level. They are appointed by the President and approved by the Senate. These are lifetime positions.
(At local level, there shall be 34 provincial Courts of Superior, and there shall be each Court of Reconciliation for each administrative unit of village level. The judges for the Superior Courts and Reconciliation Courts are elected by the residents. The term is 4 years.)
Article 7. The Republic of Vietnam Government in Exile enforces the execution of the above order.
